Terms of Service

These Terms of Service govern your access to and use of the fyzscore app, provided by fyzscore, operated by an independent app developer based in Ukraine. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

For software licensing terms specific to the mobile app, see our End User License Agreement.

1. Eligibility — 17+

The Service is intended for users who are at least 17 years of age. The Service involves body-composition content and the capture of photographs of the human body and carries a 17+ maturity rating. By using the Service you represent and warrant that you are 17 or older. We may terminate accounts we reasonably believe belong to users under 17.

2. The Service — what it does and does not do

fyzscore lets you capture photographs and receive an AI-generated, estimated body-fat range, physique score, muscle-by-muscle breakdown, and related guidance.

Estimates only. All outputs are statistical estimates produced by automated AI vision analysis. They are approximate and may be inaccurate.
Not medical advice. The Service does not provide medical, diagnostic, nutritional, or fitness advice and is not a substitute for consultation with a qualified healthcare professional. Do not use the Service to diagnose, treat, or prevent any condition. Consult a physician before making changes to diet, exercise, or health routines. See Section 8.
No social feed. The Service is private by design. There is no public profile, social feed, or sharing surface where other users can view your photos or results.

3. Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it current.

4. Your content and photos

You retain ownership of the photographs and other content you submit (“User Content”). You grant us a limited license to process, store, and analyze your User Content solely to provide the Service to you (e.g., running AI analysis and showing you your history).

How we handle photos is described in detail in our Privacy Policy. In summary:

Photos are encrypted at rest and stored privately.
Photos are, by default, automatically deleted after 90 days (or sooner if you delete them).
Photos are never published to any social feed and are not used to train AI foundation models.

5. Acceptable use

You agree not to:

upload photos of any person who is not you, or who has not consented and is not of eligible age;
upload illegal content, including child sexual abuse material (CSAM) — such content is reported to authorities as required by law;
reverse engineer, scrape, or attempt to disrupt the Service;
use the Service to harass, defame, or harm others;
misuse the Service in any way that violates applicable law.

6. Subscriptions and payments

Certain features require a paid subscription, billed through the applicable app store and managed via our payments provider (RevenueCat). Prices, billing cycles, and renewal terms are disclosed at the point of purchase. Subscriptions auto-renew unless cancelled through your app-store account settings at least 24 hours before the end of the current period. You can manage or cancel a subscription in your app-store account settings. Except where required by law, payments are non-refundable; app-store refund policies apply.

7. Third-party services

The Service relies on third-party providers to function, including Supabase (authentication and database), Cloudflare R2 (encrypted photo storage), Anthropic (AI vision and Coach analysis), RevenueCat (subscription management), and Expo (app delivery and push notifications). Your use of the Service is also subject to those providers’ terms where applicable. See the Privacy Policy for details on data sharing.

8. Health and medical disclaimer

THE SERVICE IS FOR GENERAL INFORMATIONAL AND SELF-TRACKING PURPOSES ONLY. IT IS NOT MEDICAL ADVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR CONDITION. ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS ABOUT A MEDICAL CONDITION OR BEFORE STARTING ANY DIET OR EXERCISE PROGRAM. IF YOU HAVE OR SUSPECT AN EATING DISORDER, PLEASE SEEK PROFESSIONAL HELP.

9. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY OF AI ESTIMATES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYZSCORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR RELIANCE ON AI ESTIMATES. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations of these Terms or as required by law. Upon deletion, we remove your data as described in the Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by other reasonable means. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
